Refugee Protection Claims Under the Immigration and Refugee Protection Act
Under the Immigration and Refugee Protection Act (IRPA), refugee claims are assessed under sections 96 and 97. Section 96 applies to individuals who face persecution because of their race, religion, nationality, political opinion, or membership in a particular social group. Section 97 extends protection to those at risk of torture, threats to life, or cruel and unusual treatment if returned to their country.
